On the 1st of December 2010 the Queensland Government introduced the latest pool fencing laws. The new pool safety laws have made it necessary for a home owner selling their property with a pool or a landlord wanting to lease their property to arrange a Pool
Safety Inspection and obtain a Compliance Certificate. The certificate of compliance also known as a pool safety certificate or Form 23 is valid for 2 years for all non-shared pools ie. Home pools not shared by more than one lot owner.

Leasing your property and have a tenant ready to move in? You’ll need a Pool Safety Certificate prior to taking any rent from the tenant. If your pool fence is compliant on the first inspection we’ll issue your pool safety certificate the same day.
A pool fence inspection involves checking the entire pool barrier including any pool gates, boundary fences, balconies, retaining walls or buildings that act as part of the pool fence, preventing access to the pool enclosure. All barriers acting as the pool fence must comply with the Australian Standards and Queensland Development Code MP3.4 2010.
For selling a house or unit with a pool or spa
A swimming pool safety Certificate is now required at time of Settlement. The seller can either choose to obtain a pool safety certificate by arranging a pool fence inspection prior to selling or they can choose to pass the responsibility onto the buyer of the property. To do this the seller must provide the buyer with a Form 36 -disclosure to buyer of no pool safety certificate.
The buyer if they proceed to purchase the property must obtain a pool safety certificate for the pool fence within 90 days of settlement. This means the buyer is left with the burden of paying for any repairs required to make the pool fence compliant, which in some situations can cost Thousands of dollars.
As the buyer of a property without a pool compliance certificate, we strongly advise arranging an independent pre-purchase pool fence inspection prior to settlement. BUYER BEWARE
